Terms of Service

1. Acceptance of Terms

By accessing or using the Via Echo application and services (“Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

Via Echo provides AI-powered coaching and connects users with human coaches. The Service includes voice-based AI coaching sessions, journaling, mood tracking, and the ability to book sessions with certified human coaches.

3. Important Disclaimer

Via Echo is not a substitute for professional mental health care. Our coaching services (both AI and human) are designed for personal development, self-reflection, and goal-oriented coaching. They are not therapy, counseling, or medical treatment.

If you are experiencing a mental health crisis, please contact your local emergency services or a mental health professional immediately.

4. Account Registration

To use the Service, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must be at least 16 years old to use the Service.

5. Subscriptions & Payments

Via Echo offers free trial and paid subscription plans. Subscriptions are processed and billed through either the Apple App Store (on iOS) or the Google Play Store (on Android), depending on the device you used to subscribe. By subscribing, you agree to the pricing and payment terms presented at the time of purchase.

  • Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. The renewal charge is taken within 24 hours of the period ending.
  • You can manage and cancel subscriptions at any time through your App Store account settings (iOS) or your Google Play account settings (Android). You can also access subscription management from inside Via Echo via Profile → Subscription → Manage Subscription.
  • Refunds are handled exclusively by Apple or Google according to their respective refund policies. Via Echo cannot directly issue refunds for store-billed purchases.
  • If you cancel during a free trial, you will not be charged. If you cancel after the trial converts to a paid subscription, you will retain access until the end of the current billing period and will not be charged for the next period.
  • Price changes will be communicated in advance per the applicable store's policy, and you will have the option to cancel before the new price takes effect.

6. AI Coaching

The AI coaching feature uses artificial intelligence to facilitate coaching conversations. While built on professional coaching methodology, AI responses are generated by machine learning models and should not be treated as professional advice. The AI coach does not have emotions, lived experience, or the ability to fully understand your unique situation.

7. Human Coaching

Human coaches available through Via Echo are independent professionals. While we verify their credentials, the coaching relationship is between you and the coach. Via Echo facilitates the connection but is not responsible for the content or outcome of human coaching sessions.

8. User Conduct

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to reverse engineer or extract the AI models
  • Share your account with others
  • Use the Service to harass or harm others
  • Upload malicious content or attempt to compromise the Service

9. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by Via Echo. You retain ownership of your journal entries, session transcripts, and other content you create through the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Via Echo shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may delete your account and all associated data at any time through the app settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of significant changes through the app or email. Continued use of the Service after changes constitutes acceptance.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of Spain and, where applicable, the European Union. Any disputes arising from or relating to these Terms or the use of Via Echo shall be subject to the exclusive jurisdiction of the competent courts of Barcelona, Spain, unless mandatory consumer-protection law grants you the right to bring proceedings in the courts of your country of residence.
